Terms of Use
1. Who provides Fitner
Fitner is provided by Mairis Baumanis, Latvia (business name [to be added]). Contact: [contact email — to be added].
By using Fitner you agree to these terms. How your data is handled is explained in the Privacy Policy.
2. Who can use Fitner
You must be at least 16 years old. You may use Fitner only with your own data, on your own iPhone and in browsers you connect yourself.
3. Price
Fitner is free. There are no payments or subscriptions, so there is nothing to refund. If paid features are ever added, they'll be sold through the App Store, and refunds are handled by Apple under its own rules.
4. Estimates and calculations
Heart-rate zones, training load, recovery, readiness, biological age, strength comparisons, race predictions and similar figures are estimates based on published methods and on the data your devices record. Watch and phone sensors can be wrong, and estimates can be wrong. Use them as general information, not as instructions — you decide how you train.
5. Using Fitner fairly
Please don't:
- try to access anyone else's data, or get around the login;
- overload, attack or probe the service, or send it data meant to break it;
- copy or resell the service.
To keep Fitner working for everyone, uploads per device per day and new devices per network per day are limited. A normal first sync of years of history fits well within the limits. Access may be blocked for anyone who misuses the service.
6. Your data and your devices
Your data stays yours. You can download it and delete it at any time, as the Privacy Policy explains. Keep your iPhone and any connected browser secure: anyone using them can see your Fitner data. On a shared computer, choose Clear data or Disconnect when you're done. Only scan QR codes shown on your own screen — scanning someone else's code would give their browser your data. You can see and log out connected browsers in the app's Settings.
7. Availability and changes
Fitner is provided free and may change, be interrupted, or end. Features may be added or removed. If the service is going to end, you'll be told at least 30 days in advance where possible, so you can download your data; the stored data is then deleted.
8. Liability
Fitner is provided free, "as is". As far as the law allows, there is no guarantee that it will be error-free or always available, and no liability for indirect losses or for decisions you make based on what the app shows.
Nothing in these terms limits liability where the law doesn't allow it to be limited — for example for intentional harm or gross negligence, or for death or personal injury caused by negligence — or takes away your rights as a consumer under the law of the country you live in.
9. The iPhone app and Apple
The iPhone app is also covered by Apple's standard Licensed Application End User License Agreement; these terms add to it. Apple is not responsible for Fitner or its content, and has no obligation to provide support for it.
10. Ending your use
You can stop using Fitner at any time: delete your data in the app's Settings or on the dashboard, then remove the app.
11. Changes to these terms
If these terms change in a way that matters, you'll be told in the app or on the dashboard before the change takes effect. If you don't agree, you can stop using Fitner and delete your data.
12. Law
These terms are governed by the law of Latvia. If you are a consumer in another country, you keep the protection of that country's mandatory consumer laws, and you can bring a claim in the courts where you live.
